Employment contract in Germany: what to check before you sign
You got the offer – now the contract is on the table. Use this checklist to review the key points before signing.
A German employment contract (Arbeitsvertrag) covers salary, hours, holidays, notice and many details that matter later. Many phrases look standard but have real consequences.
Since 2022 the Evidence Act (Nachweisgesetz) requires employers to put the essential terms in writing, so you are entitled to clear information.
Note: this is not legal advice. Unions, advisory services such as Faire Integration or an employment lawyer can help with open questions.
Checklist: what belongs in the contract

| Holidays | Legal minimum 20 days on a 5-day week, typically 25–30 |
| Probation | Max. 6 months with 2 weeks' notice |
| Notice period | After probation 4 weeks by law, often longer by agreement |
| Fixed term | End date and reason, if fixed-term |

Clauses to read carefully
- Flat-rate overtime compensation: only valid if clearly limited
- Repayment clauses for training, relocation or visa costs
- Post-contractual non-compete: only valid with compensation
- Transfer clauses to other locations
- Exclusion periods after which claims lapse
- Rules on side jobs
Gross is not net
The agreed salary is always gross. After tax and social security, often only 60 to 70 percent remains depending on your tax class. Use a gross-net calculator before signing.
Specifics for international professionals
For many residence permits the immigration office requires a signed contract or a binding job offer. Make sure salary and role meet your permit's requirements, such as the EU Blue Card salary threshold.
Contracts are usually in German. Ask for an English translation if needed, but the German version is normally legally binding.
